WHAT ABOUT CUSTOMS, DUTIES AND TAXES?

The customs office of the destination country may impose customs fees, import duties, taxes, and other charges to your international order where applicable. These additional charges required for customs clearance are the responsibility of the recipient. When your order arrives at the Destination County Customs either our shipper FedEx, or the Customs office will contact you directly to arrange for the payment of any charges that may be due. In some circumstances FedEx is required to pay certain duties and taxes in advance, on a customer's behalf.

For instance, FedEx may pay an advance fee when countries require that duties and taxes be paid prior to Customs release or prior to certain items clearing customs. In these instances, FedEx will assess an Advancement Fee surcharge that will be billed to the party designated to pay duties and taxes. Please be advised that Jerry Harvey Audio LLC™ has no control over these charges. The actual amount charged by customs may differ for each country.

**International Repair Shipping Procedures**

International shipments are subject to import duties and taxes (VAT). To avoid these additional charges when shipping International repairs to Jerry Harvey Audio LLC™, a Foreign Shipper’s Declaration Form must be filled out and sent with the package. Jerry Harvey Audio LLC™ reserves the right to charge you for any fees incurred at time of package receipt due to failure of proper return procedures.

PAYMENT POLICY

Due to the nature of our products, payment must be received before new custom IEM orders or repairs will be added to our production schedule.

RETURN POLICY

CUSTOM IEM ORDERS

If you opt to cancel your order of Custom IEM before we build the Product, you must cancel the order within 24 hours or 1 business day after the order is placed. We will process your refund within 5 business days. It may take longer than 5 business days for the refund to appear on your credit card statement. We are unable to offer a refund after a custom IEM has been built or after the manufacturing process has been started. Cancellations are subject to an administrative/restocking fee of 20%.

DEFECTIVE MERCHANDISE

May be returned within 30 days of the invoice date for repair after obtaining a RMA number. You must ship the Product(s)to JHAudio™ within 10 business days from RMA submission.

If you received incorrect or damaged merchandise, we will provide you with a paid label for return shipping.

All paperwork, including warranties and instructions, must be returned along with the original packaging. Place the manufacturer’s box into a shipping box (plastic bags are not sufficient packaging). DO NOT put any stickers, labels, tape, or marks on the original manufacturer’s packaging.

NON-DEFECTIVE MERCHANDISE

Custom IEM sales are final sale. No refunds will be given on custom IEM orders.

Other items, such as accessories or apparel, may be returned within 30 days of the invoice date after obtaining an RMA number. You must ship the Product(s) to JHAudio™ within 10 business days from RMA submission.

May be subject to a restocking fee of 20%.

RETURNS PROCEDURE:

Call us at 1-866-485-9111 and request a ReturnMerchandise Authorization (RMA) number.

Please provide the following information:

• Purchaser/Business Name and order/invoice number
• Product serial number, if applicable
• Reason for return. If defective, describe specifically what is wrong.
• Merchandise should be packaged in such a way as to protect the product and its packaging.
• Clearly mark the RMA number on the outside of the shipping box.
• Include a copy of the original invoice in the package.

Such authorized parties may use the JH Audio™ Logo only as specified in their agreement with JH Audio™ and any associated Guidelines and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with JH Audio™. Unauthorized Use of JH Audio™ Trademarks

1. Company, Product, or Service Name: You may not use or register, in whole or in part, any JH Audio™ trademark, including JH Audio™-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

2. JH Audio™ Logo and JH Audio™-owned Graphic Symbols: You may not use the JH Audio™ Logo or any other JH Audio™-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from JH Audio™, such as a reseller agreement.

3. Disparaging Manner: You may not use a JH Audio™ trademark or any other JH Audio™-owned graphic symbol, logo, or icon in a disparaging manner.

4. Endorsement or Sponsorship: You may not use JH Audio™, Jerry Harvey Audio™, or any other JH Audio™ trademark, including JH Audio™-owned graphic symbols/logos, or icons, in a manner that would imply JH Audio’s™ affiliation with or endorsement, sponsorship, or support of a third party product or service without prior written approval.

5. Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing JH Audio™, Jerry Harvey™, or any other JH Audio™ trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from JH Audio™.

6. JH Audio’s™ Trade Dress: You may not imitate the distinctive JH Audio™ packaging, web site design, logos, or typefaces.7. Domain Names: You may not use an identical or virtually identical JH Audio™ trademark as a second level domain name.Not acceptable:    “jerryharveyinears.com”     “jhaudiodealer.com”     “JHaudioears.com”     “jhiem.com”

Rules for Proper Use of JH Audio™ Trademarks

1. Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service.

2. As adjectives, trademarks may not be used in the plural or possessive form.
Correct: I bought two JH Audio Layla™ IEMs.
Not Correct: I bought two JH Audios.

3. An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that. For a list of suggested generic terms see the JH Audio™ Trademark List.

4. Always spell and capitalize JH Audio’s™ trademarks exactly as they are shown in the JH Audio™ Trademark List. Do not shorten or abbreviate JH Audio™ product names. Do not make up names that contain JH Audio™ trademarks.

Proper Trademark Notice and Attribution

1. Distribution Within the United States Only
a. On product, product documentation, or other product communications that will be distributed only in the United States, use the appropriate trademark symbol (™, ℠, ®) the first time the JH Audio™ trademark appears in the text of the advertisement, brochure, or other material.

b. Refer to the JH Audio™ Trademark List for the correct trademark symbol, spelling of the trademark, and generic term to use with the trademark. Generally, the symbol appears at the right shoulder of the trademark (except the JH Audio™ Logo, where the logo appears at the left foot).

c. Include an attribution of JH Audio’s™ ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.
Following are the correct formats:

_________ and _______ are trademarks of Jerry Harvey Audio, LLC™.

2. Distribution Outside the United States:
a. Do not use trademark symbols on products, product documentation, or other product communications that will be distributed outside the United States without prior written approval or agreement in place.

b. Use one of the following international credit notices:
_________ is a trademark of Jerry Harvey Audio, LLC™, registered in the U.S. and other countries.
_________ is a trademark of Jerry Harvey Audio, LLC™.

Depictions of JH Audio™ Products

1. Endorsement or Sponsorship: JH Audio™ does not support the use of its logos, company names, product names, or images of JH Audio™ products by other parties in marketing, promotional or advertising materials as their use may create the perception that JH Audio™ endorses or sponsors the product, service or promotion.

2. Compatibility: If you are a reseller or featured artist, you may show an image of an JH Audio™ product in your promotional/advertising materials to depict that your product is compatible with, or otherwise works with, the JH Audio™ product or technology, provided you comply with the following requirements:
a. Your product is in fact compatible with, or otherwise works with, the referenced JH Audio™ product.

b. The image is an actual photograph of the genuine JH Audio™ product and not an artist’s rendering (Note: You must obtain express written permission from JH Audio™ before using any photograph owned or licensed by JH Audio™).

c. The JH Audio™ product is shown only in the best light, in a manner or context that reflects favorably on the JH Audio™ products and on Jerry Harvey Audio, LLC™.

JH Audio™ Trademark List

A trademark can be a word, phrase, symbol, or design that distinguishes the source of the goods or services. Also, as trade dress, it can be the appearance of a product or its packaging, including size, shape, color, texture, graphics, and appearance (e.g, retail store or website).

The following is a non-exhaustive list of JH Audio’s™ trademarks and service marks.

When using the marks in publications that will be distributed only in the United States, include the appropriate ™, ℠, or ® symbol on first use. For publications that will be distributed outside the United States, do not include trademark symbols. Instead use the appropriate trademark attribution notice, for example: JH Audio™ and Jerry Harvey Audio™ are trademarks of Jerry Harvey Audio, LLC™, registered in the U.S. and other countries.

Trademarks are adjectives, and should not be made into verbs or made plural or possessive. For more information on how to use JH Audio’s™ trademarks, refer to the document titled, “Guidelines for Using JHAudio™ Trademarks,” or contact the Marketing team. The absence of a product or service name or logo from this list does not constitute a waiver of JH Audio’s™ trademark or other intellectual property rights concerning that name or logo.
